震惊：桑兰案撤诉的问题

刚看到OJX转的新闻，说桑兰撤案了，我查了一下案卷，相当震惊。
为什么？ 桑兰律师要求依据 FRCP 41(a)(1)(A)(i) 撤销案子，但如果你查看这条规则，只适用于被告尚未递交 answer 或者 summary judgment motion 的情况。换言之，这是在被告还没有怎么回应的时候撤诉的条款。
官司已经打到这个程度，原告要全身而退，只能跟被告达成协议撤诉, 参见FRCP 41(a)(1)(A)(ii) ，而不能无条件自主撤诉而保留再诉的权利。
